Myth of Philadelphia Courts as "Hellhole" Takes Another Hit

Civil Jury Verdict Awards Decrease 31% in Philadelphia Last Year

PHILADELPHIA, PA – The myth that Philadelphia civil courts are "extreme" or a "hellhole" continues to be countered by facts. A new summary by the legal news site law.com has found Philadelphia civil courts and juries to be impartial towards plaintiffs or the defense.

"This new data reinforces the truth that Philadelphia's civil courts really are among the best in the nation" said Michael Morrill, Executive Director of Keystone Progress. "Our courts can't give into the myths and falsehoods that extreme groups like the American Tort Reform Association are known to construct."

The new summary says Philadelphia civil jury verdicts were nearly split in their decisions between plaintiffs and defense. For civil jury verdicts, plaintiffs won 51.4% of the time, while for judicial awards only 53.5% of the time did plaintiffs win.

Philadelphia civil juries decreased its plaintiff award amounts by 31% and lowered the total number of verdicts that were over $1 million from 36 to 32. Additionally, the average civil jury award amount in Philadelphia dropped from $1.49 million in 2010 to $1.2 million in 2011.

These recent findings only bolster a recent report by Taking Back Our Courts: Justice for Philadelphia Courts. The report finds that Philadelphia’s civil courts are among the best in the country. By citing independent data, the report concludes that Philadelphia’s courts have been maligned by innuendo, false information and a well-funded campaign by pro-corporate lobbying organizations.

The recent report, Justice for Philadelphia Courts: A qualitative and quantitative analysis on the quality ofjustice administered by Philadelphia Courts, is the first to combine all of the most recent data available measuring the effectiveness and fairness of Philadelphia’s courts.

The most recent official reports paint a far different picture than the portrait constructed by national special interest groups. Far from being a “judicial hellhole” overrun by frivolous cases, the data show that Philadelphia’s court system not only has an appropriate number of cases, but it handles them quickly and efficiently with no obvious bias for or against one side.
The report found the following:

● The National Center for State Courts praised Philadelphia’s Complex Litigation Center (CLC) for its high levels of success in accuracy and fairness of a large number of complex cases in its courts. Furthermore, the NCSC recognizes that the Philadelphia court's handling of civil jury cases is now better than that of any large urban trial court in the United States.

● Comparing the plaintiff median amounts awarded in tort trials to other courts in the most populous counties in the United States, Philadelphia courts are significantly below the national median. For example, the median award amount of winners in New York, NY was $227,000, in Miami (Dade), FL it was $128,000 and in Los Angeles, CA it was $106,000. Philadelphia tort trial plaintiffs won a median amount of $20,000.

● The Philadelphia courts have been awarded a number of accolades. The list in the report highlights only a sampling of the awards that the First District Court has won over the past 7 years.

● Philadelphia ranks in the bottom 30% of major metropolitan areas in terms of median final damage amounts awarded to plaintiffs in tort trials.

Recent attacks by well-funded corporate lobbying groups have been driving the narrative that Philadelphia courts are among the worst in the nation. This includes the American Tort Reform Association's (ATRA) targeting of Philadelphia courts in its most recent Judicial Hellholes report.

The new report cites independent sources who concluded that the "evidence" in the Judicial Hellhole's report is "substantively inaccurate and methodologically flawed."

Recent reforms made by Philadelphia courts, in particular those initiated by Common Pleas Court Judge W. Herron, increasingly have been seen to be the result of the courts bending to outside political pressure by extreme conservative groups like the American Tort Reform Association and the U.S. Chamber of Commerce.

TAX DAY: TAXPAYERS TO PROTEST 1% TAX DODGERS “WE PAID OUR TAXES TODAY, DID YOU?”


LANGHORNE-This Tax Day, Tuesday, April 17, taxpayers are taking to the streets to demand the 1% pay their fair share. The protests are part of the growing wave of voter discontent against the rich, big corporations and politicians who have created an economic emergency for the 99%.

A group of protestors, who last month called on Rep. Fitzpatrick to reject the devastating Ryan Budget and instead support a fair budget for the middle class, will return to his district office in Langhorne on Tuesday at 11:00am to find out where he stands with on the Buffett Rule. Local taxpayers will line up outside of Rep. Fitzpatrick’s Langhorne office to share their stories and call of their Congressman Rep. Fitzpatrick to support the Buffett Rule (H.R.3909,the Paying a Fair Share Act), which stops millionaires from paying lower taxes than working people, and to close corporate tax loopholes. The protesters will then pour into Rep. Fitzpatrick’s office to determine his position on the Buffett Rule and whether he stands with the 99% or the 1%.

While local schools lay-off teachers and cut electives, bridges crumble and public transit limps towards extinction the 1% and profitable corporations leave an unpaid tax bill of over $2.15 trillion.

Members of the 99% have been protesting rich corporations and individuals since last summer and will continue to make their voices heard on Tax Day and throughout “99% Spring” at corporate headquarters, shareholder meetings and congressional offices.

April 12th marks the six year anniversary of the Mitt Romney’s healthcare plan for Massachusetts, which served as a template for President Obama’s landmark legislation, the Patient Protection and Affordable Care Act.

On the campaign trail, Romney continues to attack the Affordable Care Act, threatening to repeal healthcare reform if he wins this November.  However, his criticisms are invalid because he created the blueprint.

Exchanges: Both programs create exchanges where private insurers compete. 

Individual Mandate:  Both require individuals to purchase insurance, and both offer subsidies to those who can’t afford it as a way of expanding coverage to the uninsured.

Young Adults:  Romney’s Massachusetts plan allows young adults to stay on their parent’s health insurance plan until they are 26, a component of the ACA that has provided coverage to more than 2.5 million more young adults. 

Today, benefits of the Affordable Health Care Act continue to kick in. This year, insurers must see that at least 80 percent of their premiums go to benefits and quality improvements. In 2014 we can look forward to the competitive health insurance marketplace, which will provide consumers with a clear understanding of benefits offered by insurance plans.

Philadelphia Mock Bake Sale for Public Education

Don't forget, this Thursday (4/12) is the Philadelphia Mock Bake Sale for Public Education.  Several state legislators have already agreed to attend the 4PM rally and this is an excellent opportunity to show our policymakers that we support public schools!  Below you'll find the email we sent out last week with all of the details on this important event.  We hope to see you there!

On April 12th, Education Voters is partnering with Philadelphia parents, students and community members to hold a mock bake sale to protest state budget cuts and insufficient funding for public schools.  The message we are sending is that we can't possibly sell enough cookies to cover the budget gaps caused by systemic underfunding of public schools.  Elected officials at all levels need to come up with the necessary resources to provide an opportunity to learn for every student!

This event will be held at City Hall.  At 2pm, there will be a cookie delivery to members of City Council.  Then at 4pm there will be a rally and cookie event outside, with parents and students.

Coca-Cola, PepsiCo, Kraft Foods, Intuit leave corporate front group over controversial stands

(Harrisburg, PA)In the past few days, major corporate sponsors of the American Legislative Exchange Council (ALEC) have indicated they will not renew their memberships to the controversial conservative organization. Coca-Cola, PepsiCo, Intuit and Kraft Foods announced their departure amid mounting criticism over ALEC's backing of "Stand Your Ground" gun laws, which have been implicated in the shooting death of Florida teen Trayvon Martin.

Keystone Progress is now urging Pennsylvania legislators to follow suit and terminate their ALEC memberships.

ALEC is behind the efforts in Pennsylvania to pass bills that strip away union rights, scale back child labor laws, attack the regulation power of environmental agencies, suppress voter rights with strict identification requirements, eliminate the social safety net, and privatize public services.


 ALEC has written many bills for PA legislators, which have been introduced verbatim into the General Assembly. They not only have written the bills, but are frequently invited to testify on behalf of those bills once they are introduced in Pennsylvania. This model of spoon feeding legislators is a corruption of representative, open government and is an abrogation of duty on the part of our elected legislators.


Last year’s expansion of the “Castle Doctrine,” also known as “Stand Your Ground,” is modeled after ALEC’s sample bill. Laws like these have been widely criticized for promoting the sort of "vigilante justice" mindset that contributed to Martin's death.

"ALEC is not just another public policy organization, it is a front group for some of the most radical and dangerous legislation,” said Michael Morrill, executive director of Keystone Progress. “With such a proven negative track record of effect on our public policy, there's no excuse for Pennsylvania legislators to continue their involvement in the organization. These legislators should take the lead of Pepsi, Coke, Kraft and Intel and quit ALEC now.

Dear Elected Officials,
I urge you to stand up for the middle class and support closing corporate tax loopholes at the federal and state level, so that additional resources can be invested in public education and other services that build our communities.
Corporate tax loopholes are costing our schools and communities resources that would help the next generation achieve the American Dream. At a time when middle class Americans and small businesses are suffering, large, multi-national corporations are earning record profits and paying little to no money in taxes that are intended to support the communities where they do business.
Instead of robbing children of opportunities and services they need to succeed, corporations must invest in future generations by paying their fair share.
  • At the federal level, support revenue positive corporate tax reform by closing the seven largest corporate tax loopholes, which would provide an estimated $1.487 trillion in additional revenues over the next ten-years.
  • At the state level, support legislation that keeps corporations from shifting profits to low-tax burden states and require full disclosure of state and local incentives to corporations to ensure they pay their fair share to the states and communities where they do business.

Progressive Movement Compels Coca-Cola To Pull Support From ALEC Over Voter Suppression Efforts

Prompted by a petition campaign by the progressive advocacy group Color of Change, Coca-Cola has pulled its support from ALEC, a right-wing corporate-funded front group which has been pushing voter restriction efforts around the country. The company released this statement moments ago:
The Coca-Cola Company has elected to discontinue its membership with the American Legislative Exchange Council (ALEC). Our involvement with ALEC was focused on efforts to oppose discriminatory food and beverage taxes, not on issues that have no direct bearing on our business. We have a long-standing policy of only taking positions on issues that impact our Company and industry.

Corporations in PA Asked to Disclose State Taxes


Voluntary survey is designed to fill an information gap as Legislature prepares to take up business tax cuts
HARRISBURG, PA (April 3, 2012) — The Keystone Research Center (KRC) is asking Pennsylvania's 1,000 largest for-profit employers to disclose how much they pay in state income taxes. With the General Assembly poised to consider new corporate tax cuts this year, KRC officials hope the voluntary survey will provide some baseline information that is currently lacking on the state income taxes major businesses pay.
“This survey aims to fill in the gaps and help guide our work for tax fairness in Pennsylvania,” said Stephen Herzenberg, executive director of the Keystone Research Center. “A fair tax system that adequately supports public goods, like education and infrastructure, is essential to the success of every business in the commonwealth.”
State tax loopholes in Pennsylvania allow large multi-state corporations to avoid paying state taxes on income earned in the commonwealth. Across the nation, 35 of the 45 states with corporate income taxes have taken steps to close corporate tax loopholes by either enacting combined reporting or adopting expense addback laws.
Data from the Pennsylvania Department of Revenue show that 75 percent of all corporations in the state pay no state income taxes. The Keystone survey could provide more information on how much in state income taxes major companies in Pennsylvania are paying.
Keystone first sent a letter to the 1,000 companies in February asking them to voluntarily complete the tax survey. A postcard reminding them of the survey will be mailed out in early April.
While a number of corporations have responded to date, the 10 largest multi-state corporations doing business in the state have not. Based on Pennsylvania Department of Labor and Industry information, these corporations are:

  2. Giant Food Stores Inc.
  3. United Parcel Service Inc.
  4. PNC Bank NA
  5. Lowe’s Home Centers Inc.
  6. Weis Markets Inc.

Survey: New EPA Rules Offer Breath of Fresh Air to PA


(04/04/12) HARRISBURG, Pa. - The new, tougher standards for carbon pollution from coal power plants announced by the Environmental Protection Agency are getting strong public support in a new bipartisan survey, and health experts say those stricter rules also may offer key protections to unborn children in Pennsylvania.

The survey was commissioned by the American Lung Association, whose assistant vice president, Peter Iwanowicz, says it shows that more than seven of 10 respondents support the EPA action.

"The fight against carbon pollution has just begun. The EPA has taken this step to address carbon pollution from power plants but, as we saw in our poll, the public expects the EPA to do more when it comes to dealing with power-plant emissions and other pollution problems."

Judy Focareta, a maternal-child nurse in Pittsburgh, says expectant mothers and their unborn babies are especially susceptible to environmental factors which may be better kept in check under the new regulations.

"I think one of the effects that's broadly seen is the increased rate in premature births that is related to poor air quality and increased emissions."

Besides benefits to the unborn, doctors, nurses and scientists say carbon pollution is dangerous for children in general. It raises air temperatures, which worsens the smog pollution which triggers asthma attacks and can permanently reduce lung function in some children.

Focareta applauds the EPA limits and is hopeful the effort will pay off in Pennsylvania.

"While other states have improved their air quality and conversely reduced their premature-birth rates, we have not been able to move that here."

Opponents claim the new regulations will mean higher prices for electricity and may deal a crushing blow to the coal industry. However, the survey found a 2-to-1 majority believes these first-ever limits actually will create jobs rather than destroy them, by encouraging innovation.

Estudio: Las nuevas reglas de la EPA ofrecen una bocanada de aire fresco a PA


(04/04/12) HARRISBURG, Pa. - La Environment Protection Agency (Agencia de Protección Ambiental, EPA) anunció la aplicación de estándares más estrictos para reducir la contaminación de carbono proveniente de las plantas de electricidad que operan con carbón mineral. Estas nuevas normas recibieron un fuerte respaldo de la ciudadanía en una investigación bipartita, y los expertos en asuntos de la salud dicen que esas reglas más severas también pudieran ofrecer protecciones clave para los bebés que aún no nacen en Pennsylvania. El estudio fue comisionado por la American Lung Association (Asociación Pulmonar Americana); Peter Iwano wicz, Vice Presidente Asistente de dicho organismo, dice que el documento muestra que siete de cada diez respuestas respaldan la acción de la EPA.

“La lucha contra la contaminación de carbón apenas empieza. Eleva la temperatura del aire, lo cual empeora la polución atmosférica, y esto dispara los ataques de asma además de que puede reducir permanentemente la función pulmonar en algunos niños.

Focareta aplaude los límites impuestos por la EPA y espera que el esfuerzo fructifique en Pennsylvania.

“Mientras otros estados han mejorado la calidad de su aire y revertido el crecimiento de su tasa de nacimientos prematuros, nosotros no hemos podido lograr lo mismo aquí.”

HARRISBURG, PA (April 2 2012) — Pennsylvania Budget and Policy Center Director Sharon Ward issued the following statement on the House Finance Committee vote to advance House Bill 2150, legislation that would close one of Pennsylvania’s major tax loopholes and enact significant new business tax cuts. “The House Finance Committee today took a small step to address the problem of corporate tax loopholes, but that step comes at a price that Pennsylvania cannot afford.”  “HB 2150 will drain three-quarters of a billion from the state treasury annually by the end of the decade and will guarantee permanent underfunding of state colleges, public schools and health care services.” “This action undermines Pennsylvania’s long-term economic growth by putting funding for these investments at risk.  To enact major tax cuts at the same time the state is considering 20% cuts to colleges and human services, and when more than a dozen school districts are faced with severe fiscal distress, is nothing short of irresponsible.”  “The General Assembly should put the brakes on this bill, and ensure that Pennsylvania moves forward with a spending plan that it can afford.” Additional information on the legislation is available at www.pennbpc.org.

New Report Shines Light on Philadelphia Courts, Exposes Myths

PHILADELPHIA, PA – Philadelphia’s courts are among the best in the country according to a new report released today by Taking Back Our Courts.  Citing independent data, the report concludes that Philadelphia’s courts have been maligned by innuendo, false information and a well-funded campaign by pro-corporate lobbying organizations.

The new report, Justice for Philadelphia Courts: A qualitative and quantitative analysis on the quality of justice administered by Philadelphia Courts, is the first to combine all of the most recent data available measuring the effectiveness and fairness of Philadelphia’s courts.

The most recent official reports paint a far different picture than the portrait constructed by national special interest groups.  Far from being a “judicial hellhole” overrun by frivolous cases, the data show that Philadelphia’s court system not only has an appropriate number of cases, but it handles them quickly and efficiently with no obvious bias for or against one side.
The report found the following:
      The National Center for State Courts praised Philadelphia’s Complex Litigation Center (CLC) for its high levels of success in accuracy and fairness of a large number of complex cases in its courts.  Furthermore, the NCSC recognizes that the Philadelphia court's handling of civil jury cases is now better than that of any large urban trial court in the United States.

      Comparing the plaintiff median amounts awarded in tort trials to other courts in the most populous counties in the United States, Philadelphia courts are significantly below the national median. For example, the median award amount of winners in New York, NY was $227,000, in Miami (Dade), FL it was $128,000 and in Los Angeles, CA it was $106,000.  Philadelphia tort trial plaintiffs won a median amount of $20,000.

      The Philadelphia courts have been awarded a number of accolades. The list in the report highlights only a sampling of the awards that the First District Court has won over the past 7 years.

      Philadelphia ranks in the bottom 30% of major metropolitan areas in terms of median final damage amounts awarded to plaintiffs in tort trials.

“For the first time someone is reporting on what is actually happening in Philadelphia’s courts” said Michael Morrill, executive director of Keystone Progress.  “It is important to look at verifiable data when assessing our courts.”

Recent attacks by well-funded corporate lobbying groups have been driving the narrative that Philadelphia courts are among the worst in the nation.  This includes the American Tort Reform Association's (ATRA) targeting of Philadelphia courts in its most recent Judicial Hellholes report.  

The new report cites independent sources who concluded that the "evidence" in the Judicial Hellhole's report is "substantively inaccurate and methodologically flawed." 

Recent reforms made by Philadelphia courts, in particular those initiated by Common Pleas Court Judge W. Herron, increasingly have been seen to be the result of the courts bending to outside political pressure by extreme conservative groups like the American Tort Reform Association and the U.S. Chamber of Commerce. 

“Our courts should be independent of outside influence,” added Morrill.  “They should operate to assure justice for all parties, not because lobbying groups have exerted pressure based on lies and misinformation.”

"Democratizing Money - Return to Prosperity" Focus of Inaugural Public Banking in America Conference

In the wake of rising public anger at Wall Street abuses and a dramatically
increasing gap between the wealthy and a struggling middle class devastated
by Wall Street's collapse, the nation's first Public Banking in America
Conference will focus attention on a strategic plan to democratize control
of public monies through a network of state and municipal public banks.

The Public Banking Institute (PBI) sponsored conference takes place April 27& 28 at the Quaker Friends Center in Philadelphia and will feature noted
national and international monetary and banking policy advisors and leaders,
public officials, community bankers, civic organizations, unions, and
authors.

Public banking legislation is now before seventeen state legislatures and a
growing number of municipal and county elected officials. According to PBI
Chairman Ellen Brown, much of the legislation draws on the 93-year success
of the Bank of North Dakota (BND) - the only statewide public bank in the
U.S. to date - and reflects concerns shared by lawmakers across the nation.

Brown is the author of the best-selling Web of Debt.  Her articles on
American and global banking systems are published widely in the US and
abroad and she is a frequent contributor to print and broadcast media.

"From Vermont to Hawaii, legislators are looking for ways to strengthen
community banks, create sustained and affordable credit for economic
development and jobs, generate non-tax revenues, and take control of state
and municipal finance back from out-of-state mega banks," said Brown.

Brown pointed to the partnership between the BND and North Dakota community
banks, credit unions, and savings and loans as a model that other states and
municipalities can adapt to their local markets and economies.  By serving
its mission to stimulate growth and stability within the state, the BND has
been pivotal in driving the state's budget surplus and enviable financial
capabilities.

"The nationwide failure to deal effectively with home foreclosures, to
stimulate local economic development, to address collapsing tax revenue and
drastic cuts in vital services, crumbling infrastructure, and lack of jobs
are key issues that most lawmakers cite when they indicate an interest in
public banking," noted Brown.
